The copyrights to all contents of this Website are proprietary to the Company or its third-party licensors, and you may not reproduce, display, post on any other website, modify, distribute, perform, reuse, broadcast, or otherwise transmit any portion of this Website without Company’s written consent.
You represent and warrant to Company that you will not use this Website for any purpose that is unlawful or prohibited by the terms, conditions or notices in these Terms and Conditions on this Website.
The general terms and conditions apply to the use and all sales processed by the Company on the website, terms are calculated considering only business days excluding Saturdays, Sundays and holidays.
The General Conditions can be changed and/or modified at any time, eventual changes and/or new conditions will be valid starting from the date of their release, the applicable General Terms and Conditions are those in force at the date on which a purchase order is placed.
These General Terms and Conditions do not regulate the sale of products and/or supply of services by partiers other than the Company, available on the Website through links, banners or hyperlinks.
The user shall carefully read these General Terms and Conditions of Sale and all other information provided by the Company on the website, the submission of the purchase order constitutes acceptance of these General Conditions of Sale.
To conclude the purchase agreement on the Website, the user must fill out an order form in electronic format and send it to the Seller, following the step by step instructions on the website.
Once the order form has been submitted, the Seller will send the user, at the provided email address, an order confirmation containing:
Product availability is constantly monitored and updated. Nevertheless, since the Website may be visited simultaneously by various users, more than one user may purchase the same product at the same time.
Should the Product prove unavailable for the aforementioned reasons or in other cases of unexpected unavailability of the Product, the Company will immediately inform the user who will be entitled to terminate the agreement.
Alternatively, and without prejudice the user may accept:
An extension of the delivery period
A product of equivalent or higher value (in this case upon payment of the difference)
If a refund is requested, the Seller will refund in a maximum of 14 days the total sum due given by the price of the product, delivery fees where applicable and any other additional cost resulting from the purchase order.
Prices are net, do / do not include VAT and duty. Prices are expressed in EUR and ETH (Ethereum) and are per unit. Any shipping costs, duty and VAT will be charged on a per-shipment basis and are expressly and separately indicated in the order form before the user proceeds to transmit the same.
The Company hereby reserves the right to change the price at any time, without prior notice, it being understood that the price charged to the user shall be the one listed on the Website at the time the order is placed.
The Seller will deliver the Products after receiving the confirmation of successful payment of the Total Sum due by the user. Ownership of the Products will be transferred at the time of the delivery, understood as the time the product will be stocked in the cellar on the Buyer’s behalf or delivered to the Carrier at the Product’s shipment to the Buyer.
All prices are net and the payment of the total sum will be due at the moment the purchase order is transmitted. All purchase orders must be paid in full including any bank commission fees that may be deducted. We accept payment in EUR, credit card (Visa, Master Card) and Ethereum.
The delivery of the Products purchased on the website is carried out worldwide, the expenses for the delivery which may vary according to the type of delivery and destination together with any other cost due for customs and duty will be borne by the Purchaser.
The Products will be delivered within latest 12 months after the purchase, to the delivery address indicated on the original order form.
While undertaking all necessary for the proper safekeeping and storage of the wines, the Company is not liable for the state and conditions of the wines or whether the wine corresponds to the quality which might be expected from its description. Without prejudice to the fact that the risk of loss or damage to the Products for reasons not attributable to the Company are transferred when the Purchaser takes possession of the Product, we suggest to check carefully the number of products received and the integrity of their packaging, the Company must be notified of any defects or irregularities not later than 8 days after receipt or collection of the Products.
In e-commerce Swiss law does not provide for any withdrawal period or other right of return once the order has been placed but the Company decided to provide, without any obligation to do so, a 14 days right of cancellation or return of the Products, if cancellation is confirmed before the products have been shipped, the Purchaser will receive a full refund of the amount paid, if the Products are returned after receipt of the Products, the Purchaser will receive the refund of the purchase price after deduction of all fees due for delivery and transportation notwithstanding that only perfectly integer and sealed products in their original packaging can be returned.
To exercise the right of cancellation and/or return the user must inform the Company by email to info@cellarverse.io prior to the expiration of the withdrawal period of his intention to do so.
All contracts are governed by Swiss material law.
Any disputes arising from or in connection to these General terms and Conditions and resulting purchase orders shall be exclusively governed by the competent court of Lugano.
